Welcome to bazarik. These Terms of Use (“Agreement”) govern your access to and use of our 
websites bazarik.by and bazarik.ru (collectively referred to as the “Platform”), as well as our mobile application (included in the “Platform”). By accessing, browsing, or using the Platform, you (“User” or “you”) agree to comply with and be bound by this Agreement, our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you are not authorized to use the Platform.

For purposes of this Agreement, the following definitions shall apply:

• 2.1 "User" or "you"  : Any individual or entity who accesses or uses the Service, whether registered or not.
   
• 2.2 "Content": Any and all listings, images, videos, text, reviews, comments, or other materials uploaded or posted by Users of the Service.
   
• 2.3 "Services": The set of tools, features, and functionalities made available through the Platform, including its mobile applications to facilitate the creation, viewing, and interaction with classified advertisements and related content.

• 3.1 Age Restriction
  You must be at least 18 years of age to use the Services. By using the Services, you represent and warrant that you are at least 18 years old.
   
• 3.2 Account Registration
  To access certain features of the Platform, including posting Content, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to maintain its accuracy.

• 4.1 Account Security
  You are solely responsible for maintaining the confidentiality of your account credentials (e.g., username and password) and for all activities that occur under your account. You agree to immediately notify the Platform of any unauthorized use of your account.
   
• 4.2 Prohibited Activities
  You agree not to engage in any of the following activities while using the Platform:
• 4.2.1 Fraudulent Activities: 
  Posting false, misleading, or deceptive listings.
• 4.2.2 Illegal Activities: 
  Engaging in any activity that violates applicable laws, including the sale or promotion of illegal goods and services.
• 4.2.3 Spam and Unsolicited Communications: 
  Sending unsolicited communications or advertisements, including email or direct messaging.
• 4.2.4 Intellectual Property Violations: 
  Posting Content that infringes on the intellectual property rights of others.
• 4.2.5 Offensive Content: 
  Posting or transmitting any unlawful, harmful, defamatory, obscene, or otherwise objectionable content
• 4.3 Accuracy of Listings
  You agree to ensure that all Content you post is accurate, truthful, and not misleading. You shall promptly update or remove any Content that becomes inaccurate or outdated.
• 4.4 Compliance with Laws
  You are solely responsible for ensuring that your use of the Platform and Services and any transactions conducted through the Platform and Services comply with all applicable laws. The Platform reserves the right to suspend, or terminate the accounts that violate this Agreement or are deemed inappropriate at its sole discretion.
   
• 4.5 Protection of Services Code and Software
   
• 4.5.1 Ownership of Code
• 4.5.1.1. All source code, scripts, algorithms, software, and other technologies used to operate and maintain the Services, including any updates, modifications, or enhancements, are the exclusive property of the Platform and Services owner or its licensors.
• 4.5.1.2. You acknowledge that these materials are protected by copyright, trade secret, and other intellectual property laws.
   
• 4.5.2 Prohibited Actions
• 4.5.2.1. You may not:
• 4.5.2.2. Reverse-engineer, decompile, disassemble, or attempt to derive the source code of any software used to operate the Platform and Services.
• 4.5.2.3 Modify, adapt, translate, or create derivative works of the Platform and Services’ code.
• 4.5.2.4 Distribute, lease, sublicense, or otherwise transfer the rights to the Platform and Services code or software.
   
• 4.5.3 Licensing of Software
• 4.5.3.1 Any software provided through the Services may be licensed to you for personal, non-commercial use only.
• 4.5.3.2 You are not granted any ownership rights in the software or code, and all rights to the software remain with the Platform and Services owner or the respective licensors.
   
• 4.5.4 Security Measures
• 4.5.4.1 You are prohibited from using any automated tools or scripts (such as web crawlers, bots, or other data-mining tools) to interact with the Platform and Services or its code in any manner that would interfere with its normal operation, harm the Platform and Services’ functionality, or compromise the security of the Platform and Services.
   
• 4.5.5 Intellectual Property Enforcement
• 4.5.5.1 We reserve the right to take appropriate legal action if we believe that our code or software has been misused, infringed upon, or illegally distributed.

• 5.1 Ownership of Listings
  You retain all ownership rights to the Content that you post on the Platform, subject to the licenses granted herein.
• 5.2 License to Use Content
  By posting Content to the Services, you grant the Platform a non-exclusive, royalty-free, worldwide license to use, display, distribute, modify, and promote such Content on the Platform and across its marketing channels, including for advertising, promotional, and other business purposes.
• 5.3 Content Removal and Moderation
  The Platform reserves the right, but is not obligated, to remove, modify, filter, re-categorize, re-rank, hold, delay, verify any Content that violates this Agreement or is deemed inappropriate at its sole discretion.
• 5.4 Reporting Inappropriate Content
  You may report any Content that violates these Terms by using the "Report" feature in listings and where else available. The Platform will review such reports and take appropriate action, which may include removal of the Content or suspension of the user’s account.

• 6.1 Access
  Subject to the terms of this Agreement, the Platform grants you a limited, non-exclusive, non-transferable license to access and use the Platform and its Services solely for lawful purposes. The Platform reserves the right to suspend or terminate access to the Services at any time, without prior notice, for any reason, including violation of this Agreement.
   
• 6.2 Third-Party Services
• 6.2.1 Payment Processors
  The Platform utilizes third-party payment processors to facilitate transactions on the Services. By using the Services, you agree to comply with the terms and conditions of such third-party services.
• 6.2.2 Third-Party Advertisements
  The Services may display advertisements from third parties. The Platform does not control, endorse, or take responsibility for the content or practices of such third parties.
   
• 6.3 Fees and Payments
• 6.3.1 Premium Services
  Some features of the Services, such as "featured listings" or enhanced visibility, may require payment. All payments for such services are processed via third-party payment providers and are subject to their terms.
• 6.3.2 Refund Policy
  All fees paid for premium services are non-refundable, unless otherwise required by law.
   
• 6.4 Transactions Between Users
• 6.4.1 Disclaimers 
  The Platform is not a party to any transaction between users and does not guarantee the legality, quality, or safety of items listed for sale.
• 6.4.2 No Liability for Disputes
  The Platform is not responsible for resolving disputes between users, nor is it liable for any damages or losses incurred in connection with transactions conducted through the Services.

• 7.1 Privacy Policy
  The Platform collects, uses, and protects personal data in accordance with our Privacy Policy, which is incorporated herein by reference. By using the Services, you consent to the collection and processing of your personal data as described in the Privacy Policy.
   
• 7.2 Cookies and Tracking Technologies
• 7.2.1 Use of Cookies
  The Platform uses cookies and similar technologies to enhance user experience, analyze site traffic, and serve targeted advertising.
• 7.2.2 Opting Out
  You may opt out of certain cookies by adjusting your browser settings, though this may affect your ability to use some features of the Platform.

• 8.1 Termination by User
  You may terminate your account at any time by contacting the Platform customer support. Upon termination, any Content posted by you may be removed, and access to your account will be revoked.
   
• 8.2 Termination by the Platform
• 8.2.1 Grounds for Termination
  The Platform may suspend or terminate your account and access to the Services if you violate this Agreement, engage in fraudulent or unlawful activities, or otherwise disrupt  the Platform and Services operations.
• 8.2.2 Effect of Termination
  Upon termination, all rights granted to you under this Agreement shall immediately cease, and you must discontinue use of the Services. Any unpaid fees may become due.
   
• 8.3 Consequences of Termination
• 8.3.1 Content Removal
  Any Content posted by you may be removed from the Services upon termination of your account.
• 8.3.2 Data Retention
  The Platform may retain certain data, including account information, an archive of your listings, images and chat interactions with other users, as required by law or for business purposes as outlined in the Privacy Policy.

• 9.1 Platform Availability
• 9.1.1 No Guarantee of Uninterrupted Service
  The Platform does not guarantee the availability of the Services and may, from time to time, restrict access to the Services for maintenance or other reasons.
• 9.1.2 Errors and Omissions
  The Platform does not guarantee the accuracy, completeness, or reliability of any Content posted on the services.
   
• 9.2 No Warranty
• 9.2.1 AS-IS Basis
  While we strive to provide reliable and secure Services, the Services are provided "as is" and "as available." We do not guarantee that the Services will be uninterrupted, error-free, or free from viruses or other harmful components. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, without notice.
• 9.2.3 No Guarantee of Accuracy
  The Platform makes no representations or warranties regarding the accuracy, reliability, or legality of listings or Content posted by users.
   
• 9.3 Limitation of Liability
• 9.3.1 Exclusion of Consequential Damages
  To the fullest extent permitted by law, under no circumstances shall the Platform or its affiliates, partners, employees, agents, or licensors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to lost profits, loss of data, or other intangible losses, arising from:
• 9.3.1.1 Your use or inability to use the Services
• 9.3.1.2 Any interactions or transactions between users of the Services.
• 9.3.1.3 Unauthorized access to or alteration of your data.
• 9.3.1.4 Any third-party claims or content posted on the Services.
   
• 9.3.2 Exclusion of Liability for Third-Party Services
  The Services may contain links to third-party websites, services, or advertisements. We are not responsible for the content, privacy practices, or availability of any third-party websites or services. Any transactions or interactions you have with third parties through our Services are solely between you and the third party, and we will not be held liable for any disputes, losses, or damages arising from such interactions.

• 10.1 You agree to indemnify, defend, and hold harmless the Platform, its affiliates, officers, directors, employees, and agents from and against any claims, actions, demands, liabilities, losses, or damages (including attorneys' fees) arising out of or in any way connected with:
• 10.1.1 Your use of the Services.
• 10.1.2 Any violation of these Terms of Use or any applicable law.

• 11.1 These Terms shall be governed by and construed in accordance with the laws of the Republic of Belarus.

• 12.1 We reserve the right to modify or update these Terms at any time, in our sole discretion.
• 12.2 Any changes will be effective immediately upon posting to the Services, and your continued use of the Services following such changes constitutes your acceptance of the updated Terms.

• 13.1 If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

• 14.1 These Terms, together with our Privacy Policy and any other policies or guidelines incorporated in the Legal Documents section, constitute the entire agreement between you and the Platform regarding the use of the Services.
